Ein Beamtenbeisitzer, gegen den eine Disziplinarmaßnahme nach § 9 oder § 10 ausgesprochen oder gegen den wegen einer vorsätzlich begangenen Straftat die öffentliche Klage erhoben oder der Erlass eines Strafbefehls beantragt oder dem die Führung seiner Dienstgeschäfte verboten worden ist, darf während dieser Verfahren oder für die Dauer des Verbots zur Ausübung seines Amts nicht herangezogen werden.
