§ 16 Folgen unwirksamer Befristung
Ist die Befristung rechtsunwirksam, so gilt der befristete Arbeitsvertrag als auf unbestimmte Zeit geschlossen; er kann vom Arbeitgeber frühestens zum vereinbarten Ende ordentlich gekündigt werden, sofern nicht nach § 15 Absatz 4 die ordentliche Kündigung zu einem früheren Zeitpunkt möglich ist. Ist die Befristung nur wegen des Mangels der Schriftform unwirksam, kann der Arbeitsvertrag auch vor dem vereinbarten Ende ordentlich gekündigt werden.
