§ 244 Bestätigung anfechtbarer Hauptversammlungsbeschlüsse*.
Die Anfechtung kann nicht mehr geltend gemacht werden, wenn die Hauptversammlung den anfechtbaren Beschluß durch einen neuen Beschluß bestätigt hat und dieser Beschluß innerhalb der Anfechtungsfrist nicht angefochten oder die Anfechtung rechtskräftig zurückgewiesen worden ist. Hat der Kläger ein rechtliches Interesse, daß der anfechtbare Beschluß für die Zeit bis zum Bestätigungsbeschluß für nichtig erklärt wird, so kann er die Anfechtung weiterhin mit dem Ziel geltend machen, den anfechtbaren Beschluß für diese Zeit für nichtig zu erklären.
