§ 95 Zahl der Aufsichtsratsmitglieder
Der Aufsichtsrat besteht aus drei Mitgliedern. Die Satzung kann eine bestimmte höhere Zahl festsetzen. Die Zahl muß durch drei teilbar sein, wenn dies zur Erfüllung mitbestimmungsrechtlicher Vorgaben erforderlich ist. Die Höchstzahl der Aufsichtsratsmitglieder beträgt bei Gesellschaften mit einem Grundkapital bis zu | 1 500 000 Euro neun, von mehr als | 1 500 000 Euro fünfzehn, von mehr als | 10 000 000 Euro einundzwanzig. Durch die vorstehenden Vorschriften werden hiervon abweichende Vorschriften des Mitbestimmungsgesetzes des Montan-Mitbestimmungsgesetzes und des Mitbestimmungsergänzungsgesetzes nicht berührt.
