§ 352. Sundtäitmine
(1) Kui hüpoteegiga tagatud nõuet ei täideta, on hüpoteegipidajal õigus nõuda sundtäitmist täitemenetluse seadustikus sätestatud korras. (2) Enne hüpoteegiga tagatud nõude sissenõutavaks muutmist sõlmitud kokkulepe, mille kohaselt hüpoteegipidaja omandab hüpoteegiga koormatud kinnisasja hüpoteegiga tagatud nõude rahuldamiseks, on tühine.
