§ 38d Teilstationäre Pflege
(1) Aufwendungen für teilstationäre Pflege in Einrichtungen der Tages- oder Nachtpflege sind entsprechend § 41 Absatz 2 des Elften Buches Sozialgesetzbuch beihilfefähig, wenn
1. häusliche Pflege nicht in ausreichendem Umfang sichergestellt werden kann oder
2. die teilstationäre Pflege zur Ergänzung oder Stärkung der häuslichen Pflege erforderlich ist.
(2) Die teilstationäre Pflege umfasst auch die notwendige Beförderung der pflegebedürftigen Person von der Wohnung zur Einrichtung der Tages- oder Nachtpflege und zurück.
(3) Aufwendungen für Leistungen der teilstationären Pflege sind neben den Aufwendungen nach § 38a Absatz 1 oder 3 oder nach § 38b beihilfefähig.
