In Ermangelung von Bestimmungen in der Schiedsordnung oder beim Fehlen einer Schiedsordnung wendet das Gericht die in Artikel 38 des Statuts des Ständigen Internationalen Gerichtshofes angeführten Rechtsgrundsätze an. Soweit derartige auf den Streitfall anwendbare Grundsätze nicht bestehen, urteilt das Gericht ex aequo et bono. [AS 37 768]. Diesem Artikel entspricht heute Art. 38 des Statuts des Internationalen Gerichtshofes vom 26. Juni 1945 (SR 0.193.501).
