§ 26 Verbot der Zuwiderhandlung gegen Schutzvorschriften
Niemand darf 1. eine Handlung vornehmen, die gegen eine Bestimmung zum Schutz einer fakultativen Qualitätsangabe, insbesondere gegen Artikel 83 Absatz 1 der Verordnung (EU) 2024/1143, verstößt, 2. ein Erzeugnis oder sonstiges Produkt in Verkehr bringen, dessen Kennzeichnung Artikel 82 Absatz 1 Satz 3 oder Artikel 83 Absatz 1 der Verordnung (EU) 2024/1143 widerspricht, 3. eine fakultative Qualitätsangabe widerrechtlich nutzen oder nachahmen oder 4. eine Praktik anwenden, die geeignet ist, Unternehmen oder Endverbraucher in Bezug auf eine fakultative Qualitätsangabe in die Irre zu führen.
