§ 49 Prüfung der Beschränkung
Einwendungen des Schuldners, dass bei der Zwangsvollstreckung die Beschränkung auf Sicherungsmaßregeln nach der Verordnung (EG) Nr. 4/2009 oder dem auszuführenden völkerrechtlichen Vertrag oder auf Grund einer auf diesem Gesetz beruhenden Anordnung (§ 52 Absatz 2) nicht eingehalten werde, oder Einwendungen des Gläubigers, dass eine bestimmte Maßnahme der Zwangsvollstreckung mit dieser Beschränkung vereinbar sei, sind im Wege der Erinnerung nach § 766 der Zivilprozessordnung bei dem Vollstreckungsgericht (§ 764 der Zivilprozessordnung) geltend zu machen.
