1 L'autorité compétente peut, d'office ou sur requête, constater par une décision l'existence, l'inexistence ou l'étendue des droits et obligations fondés sur le droit public. 2 Elle donne suite à une demande en constatation si le requérant prouve qu'il y a un intérêt digne de protection. 3 Aucun désavantage ne peut résulter pour la partie du fait qu'elle a agi en se fondant de bonne foi sur une décision de constatation.
