§ 40b Beglaubigung einer elektronischen Unterschrift
(1) Eine elektronische Unterschrift soll nur beglaubigt werden, wenn sie in Gegenwart des Notars auf einem zur elektronischen Erfassung der Unterschrift geeigneten Hilfsmittel vollzogen und in einem elektronischen Dokument bildlich wiedergegeben wird. (2) Die §§ 13b und 40 Absatz 2 bis 5 gelten entsprechend. (3) Die Absätze 1 und 2 gelten für die Beglaubigung von elektronischen Handzeichen entsprechend.
