Art. 43 Prospektbegriff
(Art. 35 FIDLEG)
1 Als Prospekt im Sinne des Artikels 35 FIDLEG gilt ein Dokument, das die Anforderungen nach den Artikeln 40–49 FIDLEG erfüllt und:
a. von einer Prüfstelle genehmigt wurde oder nach Artikel 51 Absatz 3 FIDLEG von der Genehmigungspflicht befreit ist;
b. nach Artikel 51 Absatz 2 FIDLEG nach der Veröffentlichung geprüft und genehmigt werden muss; oder
c. nach Artikel 54 Absatz 2 FIDLEG als genehmigt gilt.
2 Zum Prospekt zählen auch die Dokumente, die durch Verweisung nach Artikel 42 FIDLEG in den Prospekt aufgenommen werden.
3 Informationsdokumente, die nicht nach Absatz 1 als Prospekt gelten, dürfen keine Bezeichnung als «Prospekt nach FIDLEG» oder damit vergleichbare Bezeichnungen enthalten.
