§ 49 Ruhestand beim Beamtenverhältnis auf Probe wegen Dienstunfähigkeit
(1) Beamtinnen auf Probe und Beamte auf Probe sind in den Ruhestand zu versetzen, wenn sie infolge Krankheit, Verwundung oder sonstiger Beschädigung, die sie sich ohne grobes Verschulden bei Ausübung oder aus Veranlassung des Dienstes zugezogen haben, dienstunfähig geworden sind.
(2) Beamtinnen auf Probe und Beamte auf Probe können in den Ruhestand versetzt werden, wenn sie aus anderen Gründen dienstunfähig geworden sind. Die Entscheidung trifft die oberste Dienstbehörde. Die Befugnis kann auf andere Behörden übertragen werden.
(3) Die §§ 44 bis 48 mit Ausnahme des § 44 Abs. 4 sind entsprechend anzuwenden.
