§ 8 Stellenausschreibung
(1) Zu besetzende Stellen sind auszuschreiben. Bei der Einstellung von Bewerberinnen und Bewerbern muss die Ausschreibung öffentlich sein. Ausnahmen von den Sätzen 1 und 2 kann die Bundesregierung durch Rechtsverordnung regeln. (2) Die Art der Ausschreibung regelt die oberste Dienstbehörde nach Maßgabe des § 6 des Bundesgleichstellungsgesetzes. Sie kann diese Befugnis auf unmittelbar nachgeordnete Behörden übertragen.
