§ 97 Begriffsbestimmungen
(1) Nebentätigkeit ist die Wahrnehmung eines Nebenamtes oder die Ausübung einer Nebenbeschäftigung. (2) Nebenamt ist ein nicht zu einem Hauptamt gehörender Kreis von Aufgaben, der aufgrund eines öffentlich-rechtlichen Dienst- oder Amtsverhältnisses wahrgenommen wird. (3) Nebenbeschäftigung ist jede sonstige, nicht zu einem Hauptamt gehörende Tätigkeit innerhalb oder außerhalb des öffentlichen Dienstes. (4) Als Nebentätigkeit gilt nicht die Wahrnehmung öffentlicher Ehrenämter sowie einer unentgeltlichen Vormundschaft, Betreuung oder Pflegschaft.
