Art. 105a Antrag auf Beschränkung oder Widerruf
1) Auf Antrag des Patentinhabers kann das europäische Patent widerrufen oder durch Änderung der Patentansprüche beschränkt werden. Der Antrag ist beim Europäischen Patentamt nach Massgabe der Ausführungsordnung zu stellen. Er gilt erst als gestellt, wenn die Beschränkungs- oder Widerrufsgebühr entrichtet worden ist. 2) Der Antrag kann nicht gestellt werden, solange ein Einspruchsverfahren in Bezug auf das europäische Patent anhängig ist.
