§ 35 Allgemeines
(1) Für eine Betriebsstätte, die zur Förderung von Bodenschätzen entsteht und nach Abschluss der Förderung endet (Förderbetriebsstätte), gelten die §§ 1 bis 17, soweit in diesem Abschnitt keine abweichende Regelung getroffen wird. Ein Unternehmen, zu dem eine Förderbetriebsstätte gehört, ist ein Bergbauunternehmen oder ein Erdöl- oder Erdgasunternehmen. (2) Ein Explorationsrecht ist das Recht, Bodenschätze zu suchen oder zu fördern.
