Art. 16 Mindestkapital bei Umwandlung eines Unternehmens in eine Bank
(Art. 3 Abs. 2 Bst. b BankG) 1 Wird ein Unternehmen in eine Bank umgewandelt, so darf das voll einbezahlte Kapital weniger als 10 Millionen Franken betragen, wenn das harte Kernkapital nach Artikel 21 ERV in Berücksichtigung der Korrekturen nach den Artikeln 31–40 ERV diesen Betrag erreicht. Die FINMA entscheidet darüber im Einzelfall. 2 Auf Sacheinlagen ist Artikel 15 Absatz 2 sinngemäss anwendbar. Fassung gemäss Ziff. I der V vom 30. Nov. 2018, in Kraft seit 1.
