Art. 63 Auslösung des Notfallplans
(Art. 25 und 26 BankG)
1 Sind die Voraussetzungen nach Artikel 25 Absatz 1 BankG erfüllt, so kann die FINMA aufbauend auf dem Notfallplan die Schutz- und Insolvenzmassnahmen nach dem elften Abschnitt des BankG anordnen, die für die Sicherstellung der systemrelevanten Funktionen notwendig sind.
2 Eine systemrelevante Bank erfüllt die Eigenmittelvorschriften nach Artikel 25 Absatz 1 BankG nicht:
a. wenn das anrechenbare harte Kernkapital 5 Prozent der risikogewichteten Positionen unterschreitet; oder
b. im Falle von Artikel 42 Absatz 3 ERV.
