§ 5 Abtretung
Ist auf den Arbeitgeber ein Anspruch auf Schadenersatz nach § 6 des Entgeltfortzahlungsgesetzes übergegangen, so ist die Krankenkasse zur Erstattung nur verpflichtet, wenn der Arbeitgeber den auf ihn übergegangenen Anspruch bis zur anteiligen Höhe des Erstattungsbetrags an die Krankenkasse abtritt.
