Kui abielu lahutati enne käesoleva seaduse jõustumist, kohaldatakse abikaasa ülalpidamisnõudele varem kehtinud õigust. See ei puuduta abikaasade vahel sõlmitud kokkuleppeid ülalpidamise kohta.
