§ 98. Halduslepingu sõlmimine haldusakti andmise asemel
(1) Haldusorgan võib haldusakti andmise asemel sõlmida üksikjuhtumi reguleerimiseks halduslepingu isikuga, kellele haldusakt oleks muidu suunatud, kui seadus või määrus ei näe otseselt ette üksnes haldusakti andmist. (2) Haldusakti andmise asemel sõlmitud halduslepinguga isikule pandavad kohustused peavad olema vastavuses lepingu eesmärgiga ja lepingust tulenevate haldusorgani kohustustega.
