Lorsque le Parquet européen se dessaisit conformément à l’article 34 du règlement (UE) 2017/1939 précité, la procédure se poursuit conformément aux dispositions applicables à l’instruction prévues au livre I er , titre III, chapitre I er si l’inculpation est obligatoire conformément à l’article 136-28 ou si elle est facultative et qu’il y a eu inculpation. Dans le cas contraire, la procédure se poursuit conformément aux dispositions applicables à l’enquête préliminaire.
