§ 87c Vermögensanfall und Liquidation

(1) Mit der Auflösung oder Aufhebung der Stiftung fällt das Stiftungsvermögen an die in der Satzung bestimmten Anfallberechtigten. Durch die Satzung kann vorgesehen werden, dass die Anfallberechtigten durch ein Stiftungsorgan bestimmt werden. Fehlt es an der Bestimmung der Anfallberechtigten durch oder aufgrund der Satzung, fällt das Stiftungsvermögen an den Fiskus des Landes, in dem die Stiftung ihren Sitz hatte. Durch landesrechtliche Vorschriften kann als Anfallberechtigte an Stelle des Fiskus eine andere juristische Person des öffentlichen Rechts bestimmt werden. (2) Auf den Anfall des Stiftungsvermögens beim Fiskus des Landes oder des Bundes oder bei einer anderen juristischen Person des öffentlichen Rechts nach Absatz 1 Satz 4 ist § 46 entsprechend anzuwenden. Fällt das Stiftungsvermögen bei anderen Anfallberechtigten an, sind die §§ 47 bis 53 entsprechend anzuwenden.
