§ 40 Voraussetzungen einer Beförderung
Eine Beamtin oder ein Beamter kann befördert werden, wenn 1. sie oder er nach Eignung, Befähigung und fachlicher Leistung ausgewählt worden ist, 2. im Fall der Übertragung einer höherwertigen Funktion die Eignung in einer Erprobungszeit nachgewiesen wurde und 3. kein Beförderungsverbot vorliegt. Die Beförderung erfolgt in den Fällen, in denen die Amtsbezeichnung wechselt, durch Ernennung.
