§ 120 Obliegenheitsverletzung des Dritten
Verletzt der Dritte schuldhaft die Obliegenheit nach § 119 Abs. 2 oder 3, beschränkt sich die Haftung des Versicherers nach den §§ 115 und 117 auf den Betrag, den er auch bei gehöriger Erfüllung der Obliegenheit zu leisten gehabt hätte, sofern der Dritte vorher ausdrücklich und in Textform auf die Folgen der Verletzung hingewiesen worden ist.
