Kohus lahendab kaebuse Riigikogu, Riigikogu juhatuse, Vabariigi Valitsuse või Vabariigi Presidendi otsuse peale ja taotluse Riigikogu, Vabariigi Valitsuse või Vabariigi Presidendi otsuse tühistamiseks viivitamata pärast nõuetekohase kaebuse või taotluse saamist.
