§ 12 Freie Wahl der Anlage
Vermögenswirksame Leistungen werden nur dann nach den Vorschriften dieses Gesetzes gefördert, wenn der Arbeitnehmer die Art der vermögenswirksamen Anlage und das Unternehmen oder Institut, bei dem sie erfolgen soll, frei wählen kann. Einer Förderung steht jedoch nicht entgegen, daß durch Tarifvertrag die Anlage auf die Formen des § 2 Abs. 1 Nr. 1 bis 5, Abs. 2 bis 4 beschränkt wird. Eine Anlage im Unternehmen des Arbeitgebers nach § 2 Abs. 1 Nr. 1 Buchstabe g bis l und Abs. 4 ist nur mit Zustimmung des Arbeitgebers zulässig.
