Ausstand, Zeugnispflicht 1 Ausstand und Zeugnispflicht der Mitarbeiterinnen und Mitarbeiter richten sich nach dem Verwaltungsrechtspflegegesetz und nach den Vorschriften der Straf- und der Zivilprozessordnung. 2 Hat die Mitarbeiterin oder der Mitarbeiter den Ausstand zu nehmen, ist die Sache der vorgesetzten Stelle bzw. deren Stellvertretung zur weiteren Amtshandlung zu überweisen.
